Use of Personal Information

We and our affiliated businesses, partners, and agents may use e-mail to communicate to our customers, respond to visitors' e-mails, or to inform you about events or new products. We will not send commercial solicitations via e-mail to you if you request that they not be sent.

ViaWest exercises generally accepted industry standards to protect the personal information provided to or collected by us. In the case of item (1) of "Sharing Information" above, we require the relevant businesses, partners, or agents to adhere to our policies regarding the use and protection of your personal information.
EU-U.S. Privacy Shield Framework
Our accountability for personal data that we receive under the Privacy Shield and subsequently transfer to a third party is described in the Privacy Shield Principles. In particular, we remain responsible and liable under the Privacy Shield Principles if third-party agents that we engage to process personal data on our behalf do so in a manner inconsistent with the Principles, unless we prove that we are not responsible for the event giving rise to the damage.
In compliance with the Privacy Shield Principles, ViaWest commits to resolve complaints about our collection or use of your personal information. ViaWest has further committed to refer unresolved Privacy Shield complaints to the American Arbitration Association, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not addressed your complaint to your satisfaction, please contact or visit the American Arbitration Association at www.adr.org for more information or to file a complaint. The services of the American Arbitration Association are provided at no cost to you. As further explained in the Privacy Shield Principles, a binding arbitration option will also be made available to you in order to address residual complaints not resolved by any other means.
